Who is responsible for strata pest control?
The laws around strata pest control differ slightly based on the state your property is located in. That said, whether you live in Northern Beaches, North Shore, or Sydney, it is generally the landlord’s responsibility to ensure any pest infestation that existed before a tenant moved in is treated.
What about pests that showed up after? In this case, the landlord is still responsible for the treatment. The body corporate’s responsibility is to conduct pest inspections, implement preventative strata pest control measures, and carry out the necessary strata pest control treatments on common property. If additional pest control treatments are carried out after this, these are at the discretion of the tenant or landlord.
Responsibility for strata pest control in NSW is shared between the body corporate (owners corporation) and individual lot owners.
Body corporate responsibility
The body corporate is responsible for pest control in all common property — foyers, stairwells, car parks, garbage rooms, gardens, roof cavities, and subfloors. Lot owner responsibility
Lot owners are responsible for pest management within their individual unit. If a pest problem originates inside a lot, the lot owner arranges and funds treatment. If it spreads from common property, the body corporate is responsible.
Landlords and tenants
If an infestation existed before a tenant moved in, the landlord is responsible for treatment. Infestations that develop during a tenancy are generally still the landlord’s responsibility — tenants should report issues promptly to their property manager.
If pests(rodents , larger cockroaches & spiders) found in an individual apartment have spread from common property — such as roof voids, subfloors, or shared walls — the body corporate is generally responsible for the treatment, even within the lot. |
